Your relationship with a real estate professional

How representation works in British Columbia when you buy, sell or lease property with Kris Kereluk Personal Real Estate Corp.

Before we provide services: Real estate professionals in British Columbia are required to present you with BC Financial Services Authority (BCFSA) consumer information and a Disclosure of Representation in Trading Services form. This explains whether we are representing you as a client and the duties that apply.

1. Regulatory requirement

Under the Real Estate Services Act and Real Estate Services Rules, Kris Kereluk, licensed with Sutton Group — West Coast Realty, must disclose the nature of our relationship with you before providing trading services. This disclosure is required by section 54 of the Real Estate Services Rules and is separate from any contract to buy or sell property.

Before you share confidential information about a real estate transaction, you should understand whether we are acting as your client or as a non-client. The official BCFSA form linked above is the document you will receive and acknowledge when we begin working together.

2. Working as a client

If you are our client, we work on your behalf. As your representative, Kris Kereluk owes you special legal duties, including:

  • Loyalty — we act only in your best interests.
  • Full disclosure — we tell you everything we know that might influence your decision in a transaction.
  • Avoiding conflicts of interest — we avoid situations that would affect our duty to act in your best interests.
  • Confidentiality — we do not reveal your private information without your permission, even after our relationship ends. This includes your reasons for buying, selling or leasing; your minimum or maximum price; and any preferred terms or conditions you want in a contract.

When you become a client, you may be asked to sign a written representation agreement setting out your responsibilities and ours.

3. Working as a non-client

If we are not representing you as a client, we do not owe you the special legal duties described above:

  • No loyalty — we may be representing another party with competing interests in the same transaction and must be loyal to our client, not you.
  • No duty of full disclosure — we are not required to give you all relevant information.
  • No duty to avoid conflicts — we are not acting in your interests.
  • No confidentiality — we must share information you tell us with our clients in the transaction.

As a non-client, we may provide only limited services. You should not share confidential information you would not want disclosed to another party in the transaction.

4. Duties that always apply

Whenever a real estate professional works with you in a transaction — whether you are a client or a non-client — they must act honestly and with reasonable care and skill.

5. Home Buyer Rescission Period

Buyers in British Columbia may have the right to cancel a contract to purchase certain types of residential property within a prescribed period. To learn more about the Home Buyer Rescission Period, visit bcfsa.ca or speak with your real estate licensee, a lawyer or a notary.

6. BC Financial Services Authority

The BC Financial Services Authority (BCFSA) is the regulatory agency that oversees real estate professionals in British Columbia. BCFSA works to ensure licensees have the skills and knowledge to provide a high standard of service and that rules protecting consumers are followed.
